Manchmal baurcht man außer die Überschrift des Heise Artikels zu nennen, gar nichts zu kommentieren Die ums Kopierschutzkalb tanzen. Für mich bloß noch ein Grund mehr Windows abzuschaffen - wenn es nicht schon geschehen wäre.
Musikbosse: Euch möge die Erleuchtung ereilen! Es hilft nichts!
Microsoft: Es wird von den Nutzern alles als unschön und nervig aufgefasst werden, was das Kopieren verhindert - oder was glaubt ihr warum soviele CD/DVD-Brenner und DSL Anschlüsse verkauft werden? Weil jeder natürlich umbedingt die DRM-Filme und die DRM Musik testen möchte....klar doch!

Ein Wurm der einen Netzwerksniffer installiert. Das wurde aber auch Zeit! Warum hat das vorher noch keiner gemacht? Wird interessant, was der Wurm so alles hört, rauschen? Wohl kaum... Vieleicht fangen die Leute ja auch an Verschlüsselung zu benutzen, genau wie jeder einen Virenscanner hat...

Na da wird der Spieß mal umgedreht. Eigentlich sind Softwarepatente ja Böse, aber dieses mal nützen sie vielleicht was.

In einem Artikel aus Spiegel Online vom 6. September gibt es eine Stellungnahme zur Idee der Musikflatrate von Gerd Gebhardt, Vorsitzender der deutschen Phonoverbände. In sieben Thesen begründet er dort warum das, von Attac-Mitgründer Oliver Moldenhauer vorgeschlagene, Modell einer Kulturflatrate nicht funktionieren soll. Hier sieben Antworten auf sieben Ausreden:

1. So wie niemand gegen seinen Willen gezwungen werden kann, sein Fahrrad zu verkaufen, entscheiden auch Musiker und Musikfirmen darüber, ob, von wem und zu welchen Bedingungen ihre Musik genutzt wird. Eine "Kulturflatrate" wäre eine Enteignung der Rechteinhaber.

Preisfrage: Was haben der aktuelle zustand Musikindustrie und mein Fahrrad gemeinsam? Richtig, beide sind Kapput!

2. Für die Umsetzung einer "Kulturflatrate" im Internet fehlt die Rechtsgrundlage. Künstler haben heute zum Glück ein Exklusivrecht, dessen Abschaffung langwierige Diskussionsprozesse und schließlich die Änderung aller nationalen Urheberrechtsregelungen voraussetzt - kaum durchsetzbar.

Sicher kaum möglich, aber nicht weil es nicht geht, sondern weil gewisse, recht einflussreiche Lobbys, das wohl nicht wollen, oder? Es ist ja nicht so als ob wir uns sträuben. Wenn ihr Anfangt, machen wir gerne mit.

3. Mit einer "Kulturflatrate" hätten legale Onlinedienste keine Chance mehr. Mehr als 20 legale Musikangebote allein in Deutschland mässten schließen. Hier würde einer Branche die Zukunft endgültig beschnitten.

Sind diese zwanzig gigantischen deutschen Musikdienste alle so erfolgreich wie Phonoline? Na, dann werden sich die fünf Menschen die das benutzen sicher ärgern, wenn sie au einmal soviel sie wollen zu einem Festpreis laden können. Sorry guys.

4. Eine "Kulturflatrate" ist ungerecht. Erna Müller aus Müllheim nutzt ihren Internetzugang nur, um ihrer Enkelin Nadine in Stuttgart regelmäßig Grüße zu senden. Warum soll sie jedes Jahr 60 Euro für etwas zahlen, das sie nie nutzt? Mehr als 30 Millionen Internetnutzer in Deutschland haben nie Musik aus dem Internet gesaugt. Eine pauschale Vergütung nutzt nur den heutigen Musikpiraten und bittet unbeteiligte Bürger zur Kasse.

Und sont sind wir alle die bösen Musikpriaten, die mit mobilen Knastwänden belehrt werden mässen, ja. Gut das ihr das erkannt habt, kaum einer "saugt" Musik aus dem Internet - darum brauchen wir doch auch kein DRM, oder? Etwa doch? Warum, denn...?
Warum werd ich das Gefühl nicht los, dass Nadine ihr Fahrrad gar nicht verkaufen wollte....

5. Zur Verteilung der pauschalen Vergütungen schlägt der Harvard-Professor Terry Fisher eine gigantische supranationale Behörde vor, die in jedem Staat über Marktforschung feststellt, was überhaupt herunter geladen wird, damit anschließend auch gerecht verteilt werden kann. Dass die Anarchie des Netzes nun ausgerechnet durch eine Superbehörde heute noch ungekannten Ausmaßes transparent werden soll, sieht eher nach einem Treppenwitz von Bürokraten als nach einer praktikablen Läsung aus.

Nicht zu vergessen, das man dass auch über eine einfach Umlage regeln könnte, ganz einfach, national, deutsch und bürokratisch. Aber so eine internationale Behörde wäre doch auch nett und bald kommt die Kontrolle über die DNS-Rootserver und die ICANN unter das Dach der UN? Dann könnten die ihre Lobbyisten mal sinnvoll einsetzen.

6. Welche Höhe die pauschalen Vergütungen haben sollen, ist völlig offen. Im Internet ist Musik nicht das einzige urheberrechtlich geschätzte Gut; Filme, Fotos, Texte und weitere Werke kommen hinzu. Sollen die auch alle pauschal vergütet werden? Welche Höhe ist dafür angemessen?

Sonst ist die Musikindustrie sich doch nicht zu schade ihren Schaden zu beziffern und CD-Prise hoch zu halten. Jetzt soll es am Preis liegen, ja?
Folgender Vorschlag: Wir machen das mit der Content-Flatrate, über den Preis wird man sich sicher einig werde. Daran solls nicht hängen.

7. "Tauschbörsen" im Internet enthalten fast ausschließlich illegale Musikangebote. Anstatt vorzeitig zu kapitulieren, muss der Kampf gegen Musikpiraterie im Internet mit allen rechtlichen und technischen Mitteln geführt werden. Und er ist keineswegs aussichtslos; erste positive Wirkungen sind schon eingetreten.

Sicher, erste positive Wirkungen zeigen, dass das virenverseuchte Kazaa gemieden wird. Auch sind die CD-Preise gesunken und jedermann hat jetzt einen iPod, zum Straßenpreis von Kokain.
Ihr glaubt also ihr kännt die Anarchie des Netzes durchdringen - wie war das nochmal mit der Superbehärde....

Die Zukunft des Musikgeschäfts liegt darin, dass - wie bisher auch - für Musik gezahlt wird.

Gemeint war mit "freier Musik" durch die Content-Flatrate eher "Free as in Freedom, not as in beer", aber was solls...

Digitale Technologien bieten ja gerade die Möglichkeiten individueller Abrechnung, die es zu nutzen gilt.

Pauschale Vergütungen sind nur da nötig, wo individuelle Abrechnungen unmöglich sind, wie z.B. bei der analogen Kopie aus dem Radio.

Oder bei P2P-Tauschbörsen? Wie kein "Kaufen" Knopf bei eDonkey - tja, da bleibt doch nur das pauschale Modell, wie Sie schon sagten.

Most of you probably have notice by now that I'm quite a fan of Macs and OS X. So I 'll give you a number of reasons why the Mac Rocks - not in the usual manner, like OS X is better because or something like that, I'll simply list Software that you only get on this platform.

1. iCal and Address Book
   iCal is not Outlook, it does not have tons of features, but it is easy, beautiful and usefull, just the right thing to organize you life.
   same thing goes for Address Book, it does what it should, it holds my addresses and has some small additional gimmicks, that make it worth using. the search works like the search in itunes, fast and for everything from name to telephone numbers. It also integrates with a bluetooth phone and with iChat - you can send SMSs out of the Address Book or begin a chat. If you ever have used the "differences" dialog of Address Book you know how this is supposed to work - i know no other app that does it so well. (a bit better LDAP support is the only thing I wish for Address Book)
2. NetNewsWire
   A simple and powerfull Software to edit you Weblog and read RSS feeds - simple and clean nothing I do not need and everything I need.
3. Keynote
   I had to give two presentations in the last semester at university, I used Keynote to create both, simply because every time I use Keynote I get the feeling it is designed the way I create presentations, as opposed to PowerPoint where you first have to configure a thousand buttons (most times turn them off) to work properly. The best thing in Keynote are the help lines that help you to drag an object to the right position (center, left border etc.).
4. SubEthaEdit
   Everyone who has collaborated on code using the combination of SubEthaEdit and iChat voice chat, or who has made notes in a lecture together with other students using SubEthaEdit knows why it rocks. (by te way, Rendevouz rocks wherever it is used, because it makes life just easy)
5. iChat
   iChat is (despite the lack of the possibility to connect to more than just the AIM network) the best chat software I have ever known. The interface is simple an d powerful something that you cannot honor to to much if you take a look at AIm for Windows, of even the MSN Messenger with their ugly interfaces with even advertisements inside the chat program - I simply do not want ads on my GUI, no discussion. The possibility to use it as a voice chat tool or to even make video chats is nothing uncommon, but with iChat it works even through a NAT device at each end. In the nxt verson of iChat you'll even be able to use iChat of conferences (talking or even video).
6. Mail
   The spam filter (probably the most important thing in a e-mail software of todays world) simply works. It filters out most of my spam, while Spamassassin running on my mail server does filter only a third of the spam. With both combined I get almost zero spam (except for the empty spams I mentioned earlier because without words to filter a spam filter will not work - maybe just filter out any empty message?). Some people complain that Mail is quiet slow, which is true, but the performance has improved over the time. I got the chance to test Mail in the OS X 10.4 Preview and the performance is a lot better there. Also the smart folders coming up in Mail are the one thing I have wanted for a long time, as simple as smart playlists in iTunes.
   
7. iSync
   I used a lot of PDAs and mobile phones over the past years (starting with a Palm V and a Nokia 7110) and syncing always was trouble. ActiveSync (for Pocket PC) does not recognize the device every third time and creates double entries. The Palm Desktop Software does not tie in into the most used PIM apps on Windows (Outlook) and the Mac (iCal, Entourage). With iSync iI have never had these problems, although I've heard from people that it does not work so well in every situation.

Mr. John Gruber wrote a very nice article about why Windows is so much affected by Worms, Viruses and Spyware and MacOS X is not.

Arguing that it’s technically possible that the Mac could suffer just as many security exploits as Windows is like arguing that a good neighborhood could suddenly find itself strewn with garbage and plagued by vandalism and serious crime. Possible, yes, but not likely. The security disparity between the Mac and Windows isn’t so much about technical possibilities as it is about what people will tolerate.

There he's right. Mac users would not accept the actual state on Windows! The problem is, if you do work in (Windows) support for a company or you are just a kind person and help your friends out of their Windows misery, you notice one thing. Most people just don't care! They don't care about privacy, computer security, etc.. They probably just can't imagine that the situation can be different than it is today in the Windows world. There a at least a dozen exapmles of that kind that come to my mind right now of people that do not care, do not think. People are not interested, because of various reasons, they are to lazy, they think it's to complex, they 'fear' the unknown or they just walk with the hurd. And in this point Mac users are different, not because they are smarter or better educated (in the means of security or privacy, of ocurse), no, but because they have made a choice, they thougt before choosing a platform. If you buy a computer today you usualy do not choose the OS, you just use Windows like everybody does. If you choose to buy a Mac, by whatever reason, or you choose to use Linux, *BSD or whatever, you have an advantage over the peoble that use Windows, just because everybody does; I even made the expirience that people that choose to use Windows (and there are people that do and there are reasons to do so) are 'better' Windows users, that the average user.

And Mac users don’t tolerate shit.

Yes, because they chose to use this platform, because they thought it is the best and they want to keep it that way.

Can the RIAA and the record labels win the fight they are fighting against their best customers? Just look at this equation: Here is an interesting caluclation, that in average, if every bought song from the itunes Music Store went onto an iPod there would be an enourmous amount of 21 songs on every iPod sold. But I don't think all those iPods are empty - do you? The site also proposes a solutionn to that problem, a flat-fee for all-you-can-eat downloads. I hardly doubt, that the RIAA and their fellowers will agree to this, they think they can win.
